These Terms apply to all users of the site, including without limitation, users who are browsers, vendors, customers, merchants, actual and/or potential brand ambassadors, and/or contributors of content. If these Terms are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service.

To the extent your social media username, real name, image, appearance, voice, likeness, caption, location or other identifying information (“Identifying Information”) are included as part of your Social Media Content, you hereby grant the Licensing Parties the right and license to use such Identifying Information in connection with any use of your Social Media Content. We will make commercially reasonable efforts to credit you for any such Social Media Content by posting your handle or byline, however we make no assurance to do so and you agree that we are not required to do so. When you use the hashtag #soulcraft, #soulcrafting, or other hashtags sponsored or affiliated with SoulCraft Canada, you represent and warrant that

(i) you own all rights in and to your Social Media Content, or are not aware of any third-party rights that must be obtained to grant the Licensing Parties the rights provided herein;

(ii) all person(s) appearing in your Social Media Content have granted permission for the uses and rights described herein;

(iii) you are of legal age to consent to this agreement; and

(iv) you are not aware of any reason why the use of your Social Media Content by the Licensing Parties as described herein will violate the rights of any third party or any law. You agree you will not post or encourage others to post Social Media Content that is unlawful, harassing, defamatory, obscene, libelous, or otherwise objectionable.

Ownership

Except with respect to Your Content, you acknowledge and agree that, as between you and SoulCraft Canada, SoulCraft Canada owns all rights, title and interest (including all intellectual property rights) in the Service and all Content and other materials within the Service. The Service is protected by Canadian and international copyright, trademark, patent and other intellectual property laws and treaties. Either reserve all rights not expressly granted to you.

Registration and Membership; Product Sales

In order to start your ongoing SoulCraft Canada subscription, you must register as a member on our Website. To register you can simply provide your shipping information including your address and billing information, and your valid email address and password to create your login profile. For your convenience as a SoulCraft Canada member, all information that you provide to SoulCraft Canadais subject to SoulCraft Canada’s Privacy Policy. You are responsible for keeping your registration information up to date through the account page on the Website. As a registered user of SoulCraft Canada, you agree to receive emails promoting any special offer(s), including third-party offers. We may from time to time send you billing reminders, shipping notices and newsletters. You may opt-out from receiving our emails by emailing soulcraftcanada@gmail.com or selecting to unsubscribe as may be provided in the applicable e-mail correspondence.

Subscriptions; Automatic Renewal; Cancellation Policy

Members subscribing before the 24th of the month will receive a craft box that same month, otherwise if signing up after the 24th they will receive a craft box the following month. We will ship you a package containing a DIY art or craft activity consisting of materials and access to a project guide. Each cycle of your subscription, the art or craft activity and materials will change. Accordingly, SoulCraft Canada cannot guarantee that materials available in a particular timeframe will be available in any subsequent timeframe. Craft boxes will be shipped to your address at the price listed. You may receive emails regarding your account or promotions for special offers, including third party offers. You may change your email preferences or cancel your membership at any time by emailing us at soulcraftcanada@gmail.com.

CONTINUOUS SUBSCRIPTION AND AUTOMATIC RENEWAL TERMS

BY SUBSCRIBING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT

(1) SoulCraft Canada (OR ANY THIRD-PARTY PAYMENT PROCESSOR) IS AUTHORIZED TO CHARGE YOU ON A RECURRING BASIS AT THE THEN-CURRENT SUBSCRIPTION RATE (IN ADDITION TO ANY APPLICABLE TAXES AND OTHER CHARGES) FOR AS LONG AS YOUR SUBSCRIPTION CONTINUES WITHOUT FURTHER AUTHORIZATION FROM YOU, AND

(2) YOUR SUBSCRIPTION WILL BE AUTOMATICALLY RENEWED FOR SUCCESSIVE PERIODS UNTIL YOU CANCEL YOUR SUBSCRIPTION. SoulCraft Canada MAY SUBMIT PERIODIC CHARGES (E.G., MONTHLY) WITHOUT FURTHER AUTHORIZATION FROM YOU, UNTIL YOU PROVIDE PRIOR NOTICE THAT YOU HAVE TERMINATED THIS AUTHORIZATION OR WISH TO CHANGE YOUR PAYMENT METHOD WITHIN THE 24-HOUR NOTICE REQUIREMENT. WE RESERVE THE RIGHT TO REVOKE YOUR SUBSCRIPTION AT ANY TIME. MEMBERSHIP IS VOID WHERE PROHIBITED BY LAW.

Modifications to The Service and Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Products or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of SoulCraft Canada. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Third-Party Products and Services

Certain products and services available via our Service may include materials from third parties. We are not responsible for examining or evaluating the content from third parties. We disclaim all warranties of any kind, including but not limited to any express warranties, statutory warranties, and any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Cancellation Policy

If you are not completely satisfied with SoulCraft Canada, you can cancel your membership and discontinue your recurring payments at any time. In order to cancel before you are re-billed for the next shipment, you need to contact SoulCraft Canada at soulcraftcanada@gmail.com AT LEAST 24 HOURS PRIOR TO YOUR NEXT SCHEDULED BILLING DATE (your billing date is the date you initially subscribed). If your membership has already renewed and you’d like to cancel an upcoming shipment, you must request cancellation by the 24th of the month to be eligible for a refund.

Return Policy

All subscription project boxes are made to order and are non refundable. Multi-month gift options are offered at a discount because of the upfront commitment, and are non-refundable.

Returns of SoulCraft Canada non subscription craft boxes are accepted in exchange for store credit/refund if you email us and ship back your craft box within 14 days of receiving your craft box subject to the following;

1. SoulCraft Canada craft box must be brand new in original/unopened condition with full contents and original/new packaging.

2. The box must be wrapped in an outer poly bag, or another box. Any box without protective packaging, or has missing contents will not be accepted for returns.

3. Refunds will be credited in the manner in which payment was made.

4. US orders: Once your return request is approved, please send your box using USPS.

5. Shipping charges are non-refundable for all purchases made online.

6. Customer is responsible for shipping and customs fees incurred in the return process. We do not provide store credit for returned products that are opened, used, returned after 14 days, damaged due to misuse, lack of care, mishandling, accident, abuse, or other abnormal use. We are not liable for products that are damaged or lost in transit back to us, therefore please ensure the SoulCraft Canada Box is packaged securely when being returned.

Billing and Payments

All information that you provide to register with SoulCraft Canada including your credit card information is subject to SoulCraft Canada ‘s Privacy Policy. The price of the Services and/or goods is payable in full before delivery. We accept the following credit cards at this time: Visa, MasterCard. For your convenience and continuous subscription benefits as a member, if your payment method reaches its expiration date and you do not edit your credit card information or cancel your account, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We encourage you to update your payment method information or cancel your account should you wish to discontinue your recurring purchase of Products. We use a third-party payment service in lieu of directly processing your credit card information. By submitting your credit card information, you grant SoulCraft Canada the right to store and process your information with the third-party payment service, which it may change from time to time; you agree that SoulCraft Canada will not be responsible for any failures of the third-party to adequately protect such information. All financial matters regarding your information are subject to the conditions of the third-party payment service provider’s terms of service; the current version is attached as a link at https://stripe.com/en-ca/privacy. You acknowledge that we may change the third-party payment service and move your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.

Shipping and Risk of Loss

Any merchandise purchased from our Site will be shipped by a third-party carrier. As a result, title and risk of loss or damage for such merchandise will pass to you upon our delivery to the carrier. All missing or damaged shipments or items must be reported by emailing us at soulcraftcanada@gmail.com within 14 days of shipping to qualify for a replacement or refund based on product availability. If the product is available, a replacement will be shipped and a refund will not be issued or considered. Shipping dates and/or arrival times are only estimates. Replacement of Products and credits to your account for shipped merchandise claimed as not received are subject to our investigation, which may include postal-service notification. We will adjust your account at our discretion. Blemishes to packaging will not be considered as part of a damaged item. All refunds will be at the discretion of SoulCraft Canada. Repeated claims of undelivered merchandise may result in the cancellation of your membership. Refunds will only be made to the original payment method specified at purchase. Please note that in the case of international shipping, the recipient will be responsible for any and all customs fees and duties charged.

Local Taxes

You may be charged local sales tax, GST/PST, HST, or VAT, if applicable.

Price Variation

SoulCraft Canada incurs fees when purchases are made through third party platforms. You agree to pay a higher purchase price and/or subscription fee while using these third party platforms when transacting with SoulCraft Canada.

International Access

This Website may be accessed from countries other than Canada. This Website and the Services may contain products or references to products that are only available within Canada. Any such references do not imply that such products will be made available outside Canada. If you access and use this Website outside Canada, you are responsible for complying with your local laws and regulations.

Limitation of Liability
