This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.soulcraftcanada.com (the “Site”).

a) What do we do with your info?

When you purchase something from our site, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our site, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable):

With your permission, we may send you emails about our site, new products and other updates. We never share your email.

Surveys and Giveaways: 

If you participate in one of our surveys, we may collect additional profile information. If you participate in a sweepstakes, contest or giveaway on our Services, we may ask you for your email address, phone number and/or home address, to notify you if you win. We may also ask for first and last names, and shipping addresses to verify your identity. In some situations, we may need additional information as a part of the entry process, such as a prize selection choice. These sweepstakes and contests are voluntary. We may also collect personal information at other points in our Services that state that personal information is being collected.

If you participate in a chat room, discussion forum, or post content (text, images, photographs, videos, messages, comments or any other kind of content) on our Services, you should be aware that the information contained in your posting will be stored in our servers and be broadly available to other users of the Services who will be able to see it if you post it in an area made public, such as comments on our blogs. Your expressed opinion is your own and should not be considered as reflecting the opinion of SoulCraft Canada. We also retain information on your behalf, such as messages you send (including the content of the message and the recipient data) using your Account.

Social Media Content Policy and Acknowledgment: 

In addition to any rights we may have in Your Content or Comments, by posting content, including but not limited to photographs, videos, comments, and your applicable social media handle to SoulCraft Canada labeled social media, posting such content to your social media accounts using the tag #soulcraft or #soulcrafting or otherwise associating such content with the tag #soulcraft, #soulcrafting or other hashtags sponsored or affiliated with SoulCraft Canada (“Social Media Content”), you grant SoulCraft Canada and any of its third-party content management providers (collectively, the “Licensing Parties”) a perpetual, irrevocable, royalty-free, non-exclusive, transferable, sublicensable right and license to display, copy, publish, distribute, transmit, print, create derivative works from, alter, edit and/or use your Social Media Content in any manner to be determined in SoulCraft Canada's sole discretion, including but not limited to on webpages and social media channels operated by SoulCraft Canada, and for other marketing and promotional purposes, in any media now or hereafter known, with no obligation to you whatsoever. To the extent your social media username, real name, image, appearance, voice, likeness, caption, location or other identifying information (“Identifying Information”) are included as part of your Social Media Content, you hereby grant the Licensing Parties the right and license to use such Identifying Information in connection with any use of your Social Media Content. We will make commercially reasonable efforts to credit you for any such Social Media Content by posting your handle or byline, however we make no assurance to do so and you agree that we are not required to do so. When you use the hashtag #soulcraft, #soulcrafting, or other hashtags sponsored or affiliated with SoulCraft Canada, you represent and warrant that

(i) you own all rights in and to your Social Media Content, or are not aware of any third-party rights that must be obtained to grant the Licensing Parties the rights provided herein;

(ii) all person(s) appearing in your Social Media Content have granted permission for the uses and rights described herein;

(iii) you are of legal age to consent to this agreement; and

(iv) you are not aware of any reason why the use of your Social Media Content by the Licensing Parties as described herein will violate the rights of any third party or any law. You agree you will not post or encourage others to post Social Media Content that is unlawful, harassing, defamatory, obscene, libelous, or otherwise objectionable.

 

Referrals (if applicable): 

The Services allow you to invite your friends to sign up for the Services by sharing a referral link via an SNS, e-mail or other means, or by sending invitations through SoulCraft Canada’s referral page on the App or Site. If you choose to upload your contacts to the Service, we will receive and store those contacts’ information and use it to send invitations on your behalf when you choose to do so. When you refer someone via our App or Site, your referral will include your name and, if shared with us, your photo. If you provide us with a photo, you hereby consent and allow us to include that photo and your information with your referral.

b) Consent

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, or arrange for a delivery, you consent to our collecting it and using it for that specific reason only. For example, when you subscribe to a Monthly Subscription, you consent to have your account charged on a monthly basis, until directed otherwise in writing. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact or bill you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at soulcraftcanada@gmail.com.

c) Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

d) Online Store

Payment: If you choose a direct payment gateway to complete your purchase, then Stripe Payments stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa and MasterCard. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. For more insight, you may also want to read our Terms of Service.

e) Third Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.
